Man Fires Gun During Fight at Hutchings Farm Pool

During a fight at the Hutchings Farm Subdivision pool, a 19-year-old O’Fallon man pulled out a handgun, pointed it at several people and fired five shots into the air on Jan. 6, O’Fallon Police said.

The weapon also had been reported stolen.

Jacob Anthony Aaron Davis, 19, of the first block of Congressional Way Court in O’Fallon, was charged by the St. Charles County Prosecutor’s Office Thursday with receiving stolen property.

O’Fallon Police said Davis texted and tweeted another man to meet him and fight him at the subdivision pool at 210 Hutchings Farm Parkway. The two men and numerous others met at the pool Jan. 6 and the two began fighting, according to a court document.

During the fight, Davis pulled out a .380 cal handgun from behind his back and pointed it at several people, police reported. Police said Davis pointed the handgun at the person he was fighting and told him to get on the ground. He then struck the man behind the right ear, pointed the gun in the air and fired five times.

He then fled the scene with several people.

O’Fallon Police reported that Davis admitted pointing the gun at people and firing five times into the air. Davis told police he believed the gun was stolen because the serial numbers were filed off.

However, St. Charles County Prosecuting Attorney Tim Lohmar said about 25 people witnessed the fight, and there were many conflicting testimonies about who the aggressor was in the fight. He said there were many tweets and text messages going back and forth among the group.

"Once they got to that location, what transpired up to that point that Mr. Davis fires the handgun is difficult to determine," Lohmar said. "We had enough conflicting testimony that it makes it difficult to determine exactly who was the aggressor."

"However, we do know the gun is stolen. It's not entirely clear yet how that handgun got into Mr. Davis' hands," Lohmar said.

Davis was being held in St. Charles County jail Friday. Bail was set at $10,000.
