Burger King Corporate, based in Miami, Florida, says that the owners of five Missouri Burger King locations have breached their franchise contracts.
Two O'Fallon Burger King restaurants are among the five owned by Joseph R. Gunther and Vicki Gunther that are the target of a lawsuit by Burger King Corporate. The case was filed on Jan. 28 in Miami, Florida where the Burger King corporate offices are located. The lawsuits state that the two O'Fallon locations—609 S. Main and 2882 Hwy. K—failed to make franchise payments. The monthly payments, which are a percentage of the restaurant's gross sales, cover advertising, promotions and the "use of the Burger King System and the BK Marks." Those marks include the Burger King and Whopper names as well as logos, symbols and slogans. At issue is whether Vicki Schneider owed trash or water and sewer fees on three properties that she owns in O'Fallon.
Vicki Schneider, the Ward 5 O'Fallon City Council candidate who was booted off the ballot in January after officials failed to certify her candidacy, has filed a lawsuit against O'Fallon City Clerk Pam Clement in efforts to get her name back on the ballot. Schneider, a realtor and former state representative, says Clement refused to certify her candidacy based on an incorrect opinion that Schneider was behind on paying utility bills for properties she owned. Clement, on Jan. 22, sent a final list of candidates to the Election Authority and said she could not certify Schneider—or Jim Reiter, another Ward 5 candidate—because of section 115.346 of the Revised Missouri State Statues, which states that "persons in arrears for municipal taxes or…

A U.S. Court of Appeals ruling could lead to dismissal of a Westboro Baptist Church lawsuit against St. Charles County, officials said. The U.S. Court of Appeals for the Eighth Circuit overturned a lower court’s ruling against a City of Manchester ordinance that protects the rights of funeral attendees “to mourn in peace and privacy for a limited time in a limited space.” The court concluded “that Manchester has shown a significant government interest in protecting the peace and privacy of funeral attendees for a short time in limited space.” “This is a great, common-sense decision,” said St. Charles County Executive Steve Ehlmann in a news release. “We’re confident it lays the groundwork for the case against St. Charles County to be …

After being acquitted of trespassing charges at the March 17 St. Charles County Republican Caucus, Brent Stafford said he felt vindicated, but sorry he had to go through the trial to begin with. “It was not my actions that put me in this position,” said Stafford, a St. Charles County Republican Committee member. “It was the actions of Eugene Dokes and Bryan Spencer that put me in this position. They didn’t follow the rules.” Stafford blames Dokes, St. Charles County Republican Central Committee chairman, and Spencer, a former committee member, with trying to control the caucus’ outcome and prevent a large group of Ron Paul supporters from controlling the meeting. O’Fallon Brewery President Jim Gorczyca filed suit in St. Louis County on Dec. 7 against Laura McCarthy Real Estate alleging fraudulent and negligent misrepresentation and violation of the Missouri Merchandising Practices Act regarding his purchase of 1800 W. Adams Avenue from Dr. John S. Daniels, Associate Professor Clinical Medicine at Washington University, in 2007. According to court documents Dr. Daniels and Laura McCarthy agent Helane Isaacs are also named as defendants. Gorczyca alleges that in 2007 Laura McCarthy published and gave to him a Residential Agent Standard Report regarding the Adams Avenue property which stated that the property was not located in a flood plain. Missouri Attorney General Chris Koster is suing the owners of an O’Fallon landfill for violations of Missouri’s Clean Water Law. According to the lawsuit, the now-closed R&E Sanitary Landfill, owned by St. Charles County Piping, allowed the discharge of leachate contaminated with iron exceeding permitted limitations to leak into a tributary of Perque Creek in 2006, 2008, 2009 and 2010. Renee Bungart, spokesperson for the Department of Natural Resources said the iron found in leachate forms solids called precipitates when entering streams in a sufficient amount. She said this can smother aquatic animals and their eggs. A …

A lawsuit filed by the school's landlord states the O'Fallon school owes rent for November, December and January, for a total of $75,000.
Court documents show Barat Academy’s landlord, CP-SPE LLC, filed a lawsuit on Jan. 21. The company says the school failed to pay $25,000 monthly rent for November, December and January. According to the lawsuit, Barat Academy entered a 13-month lease with CP-SPE LLC on May 21, 2010. The lease requires the school to pay an additional ten percent annually on unpaid rent from the due date until payment is made. The lease also requires a late fee equal to five percent the amount owed. Calls to Barat Academy Principal Debby Watson were not immediately returned.
