O'Fallon Men Charged in Murder of Zumwalt South Student

Police say that the incident started out as a drug deal.

 

Two O'Fallon men have been charged with second-degree murder when a Fort Zumwalt South High School student died after a drug deal went bad.

A press release from Charles County Prosecuting Attorney Tim Lohmar announced today that Second Degree Murder charges were filed against Kevin L. Labriado, Jr. and Robert J. Bathe, both of O’Fallon.

The men were charged with Accessory Murder 2nd Degree and Accessory Stealing a Controlled Substance.

Labriado and Bathe pre-arranged a drug deal with the victim. Evidence indicates that Labriado and Bathe, accompanied by three juvenile suspects, arrived at the victim’s home in Bathe’s vehicle to complete the illegal drug transaction, and refused to pay the victim for the controlled substances. 

As the victim attempted to restrain the vehicle in which all suspects were riding from leaving the scene, Bathe, the driver, sped away from the scene with the victim hanging on to the driver’s side of the vehicle. The victim was dragged for several feet, but lost his grip as the vehicle turned suddenly to the left, and the victim fell. 

Bathe’s vehicle then ran over the victim, who was pronounced dead approximately 5 hours later at a local hospital.

Fox2 News identified the victim as 17-year-old Tyler Pinner, a student at Fort Zumwalt South High School.

Both suspects are being held at the County Adult Detention Facility without bond.
